We appreciate the chance to have your business and want you to be completely satisfied. To that end, many of your questions can be answered or resolved very quickly by looking our the website or talking with our Customer Service. It is rarely necessary to return a product since we can resolve nearly anything and will work to do so promptly and to your satisfaction.
However, in the unlikely event you need to return a product and so you won’t be disappointed or surprised by our policies, please read the policies below BEFORE you buy from us. Because most of our products are very heavy and large, it costs quite a bit of money to ship and handle them so returns can be very costly.
Shipping and Handling:
Most of our products ship via common carrier freight because of the weight and size of the items. Freight carriers require that someone is available to receive the shipment. The freight delivery service we use is “Curb Side” only unless otherwise instructed or required. “Curb Side” delivery means the driver is NOT responsible for moving the boxes or pallets anywhere other than off the truck onto the curb or tree lawn. Some items may require off loading by hand or with equipment. Any assistance you give the driver, whether it is required or you offer, is solely at your own risk. We are not responsible for ANY injury you or anyone else receives from any part of the delivery process.
For some small items and orders we may have the ability to ship via standard ground service such as FedEx or UPS.
Receipt of Products:
You are responsible for checking the shipment and if necessary, either refusing it or noting damage upon receipt. If you do not do this, neither the carrier nor Direct Rubber Mulch will be responsible for any damages or charges associated with replacement of parts damaged in shipping that you accepted.
DO NOT DISPOSE OF THE BOX OR ANY PACKAGING MATERIALS UNTIL YOU HAVE INSPECTED YOUR ORDER AND ARE SATISFIED WITH THE PRODUCT YOU HAVE RECEIVED. ANY RETURNS MUST BE IN THE ORIGINAL PACKAGING.
If you cancel your order prior to it shipping, we will cancel the transaction and no fees or charges will apply.
If you wish to cancel after your order ships but before you receive it, you must refuse the shipment upon delivery. Your refund will be based upon our policies stated below.
Once you receive your order, returns are processed under our policies stated below.
You, the customer or purchaser, are responsible for complying with any and all regulations and laws that apply to your specific application of our products. Direct Rubber Mulch is not liable for non-compliance or non-adherence to any regulations or laws that apply to customer projects and installations.
Returns and Refunds:
If you are dissatisfied with a product that you bought from Direct Rubber Mulch and wish to return it, call us at 1-877-884-3660. One of our Customer Service representatives will provide you with simple instructions for returning and obtaining your refund. Please have your order information ready when you call. Issues including shipping errors, defects, or damage can be resolved quickly and do not require return of the product to resolve. If you experience shipping errors, defects, or damage and chose not to accept our resolution then the return policies below will apply.
Return and Refund Specifics:
- We will only accept a return if you contact us within 30 days of receipt of your product.
- You are responsible for any and all shipping charges associated with returning an item.
- You are responsible for returning the product(s) to the facility we designate.
- All returned products MUST be returned in like-new condition in original packaging. If we receive products back that are damaged because of inadequate packing or partial use, your refund may at our sole discretion be reduced by the restocking fee AND an amount equal to the product we need to replace to make the returned products like new again.
- We charge a 15% restocking fee for all returned products. As you can imagine, this is because it takes significant effort to prepare a returned order for re-sale and of course, the returned products cannot be sold as new so we have to sell it at a discount.
- Refunds will be made by crediting the original method of payment (i.e., credit card, etc.).
- We will not accept returns for our products that you purchased elsewhere.
Unless you cancel prior to your product shipping, the amount of your refund will be the result of the original invoice amount minus shipping charges (outbound plus if any, inbound) minus the restocking fee minus the price of any damaged product that we have to replace. Your refund will be issued after the product arrives at the facility we designate and we inspect the product for any damage.
Replacement Parts and Product:
Sometimes items are damaged during shipping or missing. Don’t worry! We’ll get you the right items quickly. Contact us at 877-884-3660 with your order or quote number and we’ll get you taken care of.
Disclaimer of Warranties:
Your use of the services and products sold by Direct Rubber Mulch is at your sole risk. Unless otherwise expressly specified in writing, the services and products sold by Direct Rubber Mulch are provided on an “as is” and “as available” basis. Unless otherwise expressly specified in writing, Direct Rubber Mulch expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non infringement.
Unless otherwise expressly specified in writing, Direct Rubber Mulch make no warranty that the services or other materials or products purchased or obtained by you from the services or on the site will meet your requirements, will be uninterrupted, timely, secure, error free, or will be accurate or reliable; the quality from the service will meet your expectations; and any errors in the services will be corrected.
No advice or information, whether oral or written, obtained by you from Direct Rubber Mulch or through or from the services shall create any warranty not expressly stated in the Terms and Conditions Statement.
Limitation of Liability:
You expressly understand and agree that Direct Rubber Mulch, it’s officers, employees, and affiliates shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Direct Rubber Mulch has been advised of the possibility of such damages), resulting from: the use or inability to use the the products and services; the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the services; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on the services; or any other matter relating to the services.
Exclusions and Limitations
Some Jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of the Disclaimer of Warranties and Limitations of Liability sections may not apply to you.
Revisions to the Terms and Conditions
Direct Rubber Mulch may revise this Terms and Conditions Agreement at its sole discretion. Each time changes are made to this Terms and Conditions Agreement, a revised Terms and Conditions Agreement will be posted on the Direct Rubber Mulch home page. If you continue to Use the Services following the posting of a revised Terms and Conditions Agreement, it will constitute your acceptance of any such changes and of the revised Terms and Conditions Agreement.
